Judicial Activism Undermines Direct Democracy

Political Scientist Dr. Dora Kingsley hopes Republicans attending the California Republican Party convention in Anaheim will reevaluate ill-conceived considerations for redistricting reform put forward by Chairman Duf Sundheim.
"Quite frankly, Prop 77 is significantly weakened by this week`s ruling in the Pledge Case. Judicial activism is not something that can be mitigated by judicial restraint." said Dr. Kingsley from her offices near the Capitol in Sacramento.
Dr. Kingsley, a member of the California Republican Party since 1987, observed in the wake of the Pledge Case ruling and the almost certain confirmation of John G. Roberts as Chief Justice of the US Supreme Court, Republican leaders have a responsibility to party principles - not expedient, short-sighted action.
As Americans and as Republicans, we believe our rights are derived from God, a Supreme Being, not from Man and we choose to live by the Rule of Law. Allowing three, five, or seven retired judges to assume a political deliberative process undermines the principle articulated best by Republican President George W. Bush`s nominee to replace Chief Justice William Rehnquist, John G. Roberts, "Judges are like umpires, umpires don`t make the rules, they apply them."
Dr. Kingsley is confident that current efforts to vacate California`s system of direct accountability by the legislative & executive branches to deliberate on political jurisdictions is a shallow effort which will have consequences.
"The negative effect on California would grow in strength. First, we would lose at least three US House of Representatives Committee Chairmen. Then, California would not have sufficient representation. And finally, the federal dollars that we require - especially as a donor state, would disappear. The deficit politically could be devastating." continued Dr. Kingsley.
Trenton West`s Media Director, Elizabeth Blackney, added, "What we have today is a question of Judge versus Judgement. And clearly, someone has mislead Chairman Sundheim & Governor Schwarzenegger about the impact an activist judge may have."
Dr. Kingsley concluded by stating, "With the Special Election hanging in the balance and Governor Schwarzenegger`s expected announcement that he plans to run for re-election, I truly hope Chairman Sundheim will rally the grassroots. To date, there has been a lot of talking and very little action."
